First time for a Disney Cruise


This mornings arrival of the Disney Magic is the first arrival for a Disney Cruise ship in Halifax.

Disney  cruises to Halifax depart from New York, and stopping in St John NB were announced in April 2011. Disney will be stoping 11 more times this year, becoming one of the regular callers.

Coastal Cruise Ship Yorktown

A small Cruise ship, She is meant to ply Coastal Waterways. She is here for the Morning (departs at 1400), and arrived from Lunenburg. A Large Irving Tanker was waiting to top up the fuel tanks, While Pasengers toured the city.

 The Great Lakes Cruise Company States:

The Yorktown is the perfect vessel for relaxed and convivial exploration of America’s great coastal waterways. Renovated in 2009, the Yorktown was built in Florida in 1988 specifically for coastal cruising. Certified by the U.S. Coast Guard, the Yorktown flies the American flag and is staffed by friendly and experienced American officers and crew.

257 feet long, 43 feet wide, with a draft of 8 feet, the Yorktown is able to maneuver in secluded waterways and visit small ports that are inaccessible to larger vessels. And Yorktown’s American registry makes it possible to operate domestic itineraries unavailable to foreign-flag ships.

AZAMARA JOURNEY – First Cruise Ship of the Season

The first Crusise ship of the Season arived this morning, on a Titanic Aniversary cruise. Unlike the Balmoral (who will be in Halifax on the 14/15th), which is retracing the Titanics voyage, the AZAMARA JOURNEY Departed New York for a Tour of Titanic related sites, arriving today in Halifax, and then heading to the sinking site on Saturday, before returning to New York. Ambassatours is running Titanic themed tours which feature a Titanic Theeme wrapped bus. The tours cover titanic sites, such as the Cable Wharf, Maritime Museaum of the Atlantic, and Fairview Lawn Cemetery.

Cruise Season Anounced

The Cruise Ship schedule for 2012 has been released, and Begins in April, with visits by 2 titanic 100th Aniversary cruises. Azamara Journey will visit Halifax on April 12 and On April 16/17, Balmoral will make an overnight stay.

The regulars Carnival Glory and Maasdam are back, and are joined by Disney Magic. The Quest for Adventure, will make two turnaround calls – one on Sept. 16 and another on Oct. 1. These turnaround calls will have passengers begin their cruise from Halifax.

Whats Up with Pearl Mist?

First Some Background.
ISI finished construction of the Vessel in April 2009, conducted dock–and–sea trials,
and on May 6, 2009 gave Pearl Seas written notice of completion of the trial run. During Consrtuction there were several changes made to the vessel design, and these were likely the source, at least in part, of the construction Delays. On May 9 Pearl Seas rejected the Vessel, aruging it is not compliant with the contract, that “would materially interfere with the operation of the Vessel.

The Contract contained an Arbitration Clause. During and after construction of the Vessel, Irving Shipbuilding and Pearl Seas repeatedly disagreed about the terms of the Contract and each other’s performance. They convened an arbitral panel to which they have submitted their numerous disputes. Perl Seas have sited several issues, including Late Delivery and deficencies (70 issues were identified, 17 of which were “[t]he most serious defects.”) including cosmetic or minor construction defects, failure to install certain Contract items, excessive noise and vibration (of HVAC), and failure to install shower stalls. As well, The Flag State Determined that the condition of ‘Pearl Mist’ is not to a standard acceptable for registration, and Pearl Seas argued the vessel was not in complicance with USCG Regulations. For these reasons, Pearl seas Terminiated the contract.

Irving Shipbuilding argued it was not in default because none of the non–regulatory defects rose to the level of a failure to perform a material requirement
of the contract, and that USCG requires that the owner of a ship must be part of the certification process, and that the “vessel must be crewed, in order to carry out the Training and Drills tests”

The arbitrator agreed with Irving, and and Pearl Seas Sued Irving in Connecticut Court to dismiss the arbitrators Verdict. In both cases the Case was dismissed. So Where does this Leave the Pearl Mist? Likely In the Arbitation Panels hands. At this point it appears that Pearl Seas will be held to the contract – though will likely recive some compensation for the deficencies (which is capped at 2 million dollars or so)

Three Cruise Ships Today

Holland America’s Eurodamm makes her first stop in Halifax today, and is birthed at Pier 20.Halifax regular and Eurodam sister ship Maasdam is also in Port Today, and is tied up at Pier 31, well within halterm – presumably due to space constraints at pier 24. Aida Aura (See yesterdays post) is a much smaller ship.
